Overview

This website is operated by Luminous Luxe Collective, trading as Luminous Luxe (“Luminous Luxe”, “we”, “us” or “our”). Luminous Luxe is the creative house of Australian artist and author Kristy Reibel.

These Terms of Service govern your access to and use of kristyreibel.com.au and any purchase made directly through this website. By accessing the website, placing an order or purchasing a product or service, you agree to these Terms of Service and to the policies linked from the website.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Products and Services

Luminous Luxe may offer original artwork, art and photography prints, digital editions, journals, Private Pages, books and novels, bags, lifestyle pieces, commissioned work and other creative releases.

We take reasonable care to present product descriptions, dimensions, materials, colours, finishes and images accurately. Screen settings, lighting, production methods and the character of handmade or printed work may result in minor variations in colour, texture, placement or finish. These variations are not necessarily faults.

Availability, editions, formats, pricing and product details may change without notice. We may limit quantities, withdraw products or correct genuine errors in descriptions or pricing.

Orders and Payment

Orders placed directly with Luminous Luxe must be submitted through the website unless otherwise agreed in writing for a commission or private acquisition.

Full payment is required at checkout unless a written commission agreement or invoice provides otherwise. Available payment methods are those displayed at checkout.

An order confirmation acknowledges that we have received your order. We may contact you if information is incomplete, an item is unavailable, a pricing or listing error has occurred, fraud prevention checks require clarification or we are otherwise unable to fulfil the order. If we cancel an order after payment has been received, the amount paid for the cancelled item will be refunded using the original payment method, subject to applicable law.

You are responsible for ensuring that your order, email address, billing information and delivery details are accurate before submitting payment.

Commissions and Private Acquisitions

Commissioned artwork and privately arranged acquisitions may be governed by a separate written proposal, quote, invoice or commission agreement. Where a specific written agreement conflicts with these Terms, the specific written agreement applies to that commission or acquisition.

Any deposit, approval process, production schedule, permitted revisions, cancellation terms, delivery arrangements and final payment requirements will be stated in the applicable written agreement.

Digital Products

Digital products are licensed, not sold, for the purchaser’s personal, non-commercial use unless a separate written licence expressly states otherwise.

You must not reproduce, share, upload, distribute, resell, sublicense, publish, modify for redistribution, commercially exploit or make a digital product available to another person. You must not remove copyright, authorship, trademark or other proprietary notices.

Access instructions and download links must not be shared. You are responsible for downloading and securely retaining your purchased files within any access period stated at the time of purchase.

Intellectual Property

All artwork, photography, books, novels, Private Pages, journals, written content, digital products, designs, branding, graphics, images, video, audio and other creative material displayed or supplied through Luminous Luxe are owned by Kristy Reibel or used with permission and are protected by intellectual property laws.

Purchasing an original artwork, print or other physical product transfers ownership of that physical item only. It does not transfer copyright, reproduction rights, licensing rights or any other intellectual property rights.

Kristy Reibel retains the right to photograph, reproduce, publish, exhibit, distribute, license and create prints, editions or derivative works from original artwork unless otherwise agreed in a signed written document.

No website content or purchased material may be copied, reproduced, republished, distributed, sold, adapted, scraped or commercially used without prior written permission.

Content from this website or any Luminous Luxe publication must not be used for text and data mining, dataset creation, machine-learning development, artificial-intelligence training or the generation of derivative content without Kristy Reibel’s prior written permission.

Website Use

You must not use this website for an unlawful, fraudulent, abusive or harmful purpose; interfere with its security or operation; introduce malicious code; attempt unauthorised access; impersonate another person; or infringe the rights of Luminous Luxe or any third party.

We may restrict or terminate access where reasonably necessary to protect the website, Luminous Luxe, our customers or our rights.

Third-Party Services and Platforms

The website may use or link to third-party services, including Shopify, payment providers, delivery providers and social platforms. Your use of a third-party service may also be governed by that provider’s terms and policies.

Purchases completed through an external marketplace, retailer or platform, including Amazon or Lulu, are governed by that seller’s checkout, fulfilment and return terms. Questions about those transactions should be directed through the platform on which the purchase was completed.

We are not responsible for the availability, content, security or practices of third-party websites that we do not control.

Shipping, Delivery, Returns and Refunds

Shipping, delivery, return and refund conditions are set out in the Shipping Policy and Refund Policy linked from this website. Those policies form part of these Terms of Service.

Nothing in those policies or these Terms limits any consumer guarantee, remedy or other right that cannot lawfully be excluded.

Privacy

Personal information is handled in accordance with the Luminous Luxe Privacy Policy and applicable privacy settings presented on the website.

Availability and Unforeseen Events

We aim to keep the website and services available, accurate and secure, but uninterrupted or error-free access cannot be guaranteed.

We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, natural events, production interruption, technology failure, industrial action, customs delay or supplier interruption. We will communicate material delays where reasonably possible.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Luminous Luxe is not liable for indirect, incidental, special or consequential loss arising from use of the website or a product or service.

Where liability may lawfully be limited, our liability will be limited, at our option, to supplying the relevant goods or services again, repairing or replacing the goods, or paying the reasonable cost of having the goods or services supplied again, repaired or replaced.

This section does not exclude, restrict or modify rights or remedies available under the Australian Consumer Law or any other law where doing so would be unlawful.

Indemnity

To the extent permitted by law, you agree to indemnify Luminous Luxe and Kristy Reibel against loss, liability, damage or reasonable expense arising directly from your unlawful use of the website, infringement of intellectual property rights, unauthorised use or distribution of purchased content, or breach of these Terms.

Changes to These Terms

We may update these Terms to reflect changes to our products, services, practices or legal obligations. The revised Terms will be published on this page with an updated date. Changes apply from publication and do not retrospectively remove rights that have already arisen.

Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to operate. A failure or delay in enforcing a right does not waive that right.

Governing Law

These Terms are governed by the laws of Queensland, Australia. Subject to any rights you have under applicable consumer law, the courts of Queensland have jurisdiction in relation to disputes arising from these Terms.
